Do I Need an EIN for My LLC? (The Real Answer)
What Is an EIN?
An EIN (Employer Identification Number) is a nine-digit federal tax ID issued by the IRS. It identifies your business the way a Social Security Number identifies you as an individual. You'll use your EIN when opening a business bank account, filing business taxes, hiring employees, applying for business licenses, working with vendors who need to issue you a 1099, and applying for business credit.
When the IRS Requires an EIN for an LLC
- Multi-Member LLCs (Always Required): If your LLC has more than one member, you are required to have an EIN. Multi-member LLCs are taxed as partnerships, which requires an EIN to file the partnership return (Form 1065).
- LLCs with Employees (Always Required): If you pay W-2 wages to anyone, you need an EIN for payroll taxes, W-2 filings, and payroll deposits.
- LLCs Taxed as a Corporation (Always Required): If your LLC has elected to be taxed as an S-Corp or C-Corp, an EIN is required.
The One Exception: Single-Member LLCs with No Employees
The IRS technically does not require a single-member LLC to have an EIN if it has no employees and hasn't elected corporate tax treatment. In this case, the LLC is treated as a "disregarded entity" and the owner can file everything under their SSN.
But here's the reality: Even if you don't technically need one, you almost certainly want one.
Why Single-Member LLC Owners Should Get an EIN Anyway
- You can't open a business bank account without it. Every major bank requires an EIN to open a business checking account. Without a business account, you're mixing personal and business funds — which destroys your LLC's liability protection.
- Protects your Social Security Number. If you don't have an EIN, vendors and clients who need to issue you a 1099 will ask for your SSN. An EIN eliminates that exposure.
- Business credit requires it. Building a business credit profile requires a business identifier — your EIN. Without it, there is no business credit history.
- Future-proofs your business. The moment you hire anyone — even a part-time assistant — you need an EIN. It's easier to get it now.
- Looks more professional. When clients ask for your tax ID, providing an EIN says "I have a real business."
